Introduction
These Terms of Use (“Terms”) are a legal agreement between you and XINDA ARK TRADING CO., LIMITED (“Company,” “we,” “our,” or “us”) governing your access to and use of https://qalibmobile.com (the “Site”) and any content, documentation, software, text, images, video, audio, and services offered on or through the Site (collectively, the “Services”), whether as a visitor or registered user. Your use of the Services is conditioned on your acceptance of these Terms and any additional terms provided when you use certain features.

Please read these Terms carefully. By registering for an account, making a purchase, or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

These Terms include a mandatory Arbitration provision that requires individual arbitration to resolve disputes, rather than jury trials or class actions. See the “Governing Law, Mandatory Arbitration, and Class Action Waiver” section below.

Changes to the Terms of Use
We may update these Terms at any time at our sole discretion. Changes are effective immediately upon posting and apply to all subsequent use of the Services. Changes to dispute resolution provisions will not apply to disputes of which the parties had actual notice before the change was posted.

We may update content on the Services, but we are not obligated to ensure it is complete or up-to-date. Content may be outdated at any time, and we have no duty to update it.

By using the Services, you represent that you are: (a) over 18 or the age of majority in your jurisdiction; (b) of legal age to form a binding contract; and (c) not barred from using the Services under applicable laws.

You are responsible for all activities under your account. Do not share your account or password. Notify us immediately of unauthorized use. Always log out after each session, especially on shared computers.

Deleting Your Account
You may terminate your account at any time by emailing us at support@qalibmobile.com.

Account Suspension
We reserve the right to suspend or delete your account at any time without notice or liability. Suspension or deletion does not entitle you to compensation or exempt you from paying applicable fees.

Reliance on Information Posted
Information on the Services is for general purposes only. We do not warrant its accuracy, completeness, or usefulness. You rely on such information at your own risk. We disclaim all liability arising from any reliance placed on such materials.

Method of Payment
All payments are processed by third-party services. We do not collect payment information. If a payment fails or is refused, we are not obligated to fulfill the order. You bear any costs resulting from failed payments.

Additional Materials & Third-Party Terms
The Services may link to third-party sites. We are not responsible for third-party content, products, or services. Your dealings with advertisers or third parties are solely between you and them. We are not liable for any related damage or loss.

Content
You are solely responsible for Content you upload or transmit through the Services. We have no obligation to pre-screen Content but reserve the right to remove any Content that violates these Terms. We do not warrant the accuracy or usefulness of Content.

By submitting Content, you represent that you have the necessary rights and that it does not infringe any third-party rights.

Feedback
If you provide feedback, you grant us the right to use, modify, and distribute it without credit or compensation.

Prohibited Uses
You may not:

Upload illegal, harmful, or infringing Content;
Impersonate others or misrepresent affiliations;
Disrupt others’ use of the Services;
Overload the Services or infrastructure;
Share or transfer your account;
Violate applicable laws;
Reverse engineer the Services;
Remove proprietary notices;
Use the Services to compete with us.
Intellectual Property Rights
You grant us a worldwide license to use Your Content in connection with the Services. We and our licensors own all other rights in the Services and Content. Our logos and trademarks are our property. All rights not granted are reserved.

Disclaimer of Warranties
Content is provided “as is.” We do not guarantee it will be error-free or harmless. You use the Services at your own risk. We disclaim all warranties to the fullest extent permitted by law.

Indemnification
You agree to indemnify us and our affiliates from claims arising from your violation of these Terms or misuse of the Services, except to the extent caused by our gross negligence, fraud, or intentional misconduct.

Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential damages. Our total liability shall not exceed the greater of $25 or the amount you paid for the Services in the past 6 months. This does not apply to liability resulting from our gross negligence, fraud, or intentional misconduct.

Governing Law, Mandatory Arbitration, and Class Action Waiver
These Terms are governed by the laws of Hong Kong SAR. Any arbitration shall be governed by the Hong Kong Arbitration Ordinance. Before arbitration, the disputing party must provide written notice and negotiate in good faith for 60 days.

All claims shall be resolved by binding individual arbitration, except for small claims. Arbitration will be administered by the Hong Kong International Arbitration Centre (HKIAC). We will pay arbitration costs if they are prohibitive for you. You may seek relief only as an individual, not as part of a class.

We may seek injunctive relief in court to protect intellectual property rights.

Copyright
To report copyright infringement, provide the following to our Copyright Agent:
(i) Signature of authorized person;
(ii) Identification of copyrighted work;
(iii) Identification of infringing material;
(iv) Contact information;
(v) Good faith statement;
(vi) Accuracy statement under penalty of perjury.

Miscellaneous
These Terms constitute the entire agreement between you and us. You may not assign your rights without our consent. Our failure to enforce a provision does not waive it. If any provision is invalid, the remainder remains in effect. We are not liable for delays beyond our control.
